After a productive workshop on the data breach impact assessment and the data breach management process we propose you a new workshop to exchange with your peers on the topic of the GDPR legal basis: their interpretation, limitation, condition, possible stretch, risks, etc.

The balancing test or legitimate impact assessment – a mandatory step when relying on the legitimate interest – will be one of the topics. The legitimate interest impact assessment involves weighing the legitimate interests of a data controller against the right and freedoms of data subjects. But the GDPR provides limited guidance on how the balancing test should be applied. Hence, it’s like balancing on a tightrope…

DPOs and Privacy specialists still have a tricky time getting to grips with the legitimate interest concept.  No wonder that several members would like to delve deeper in this complex and subjective topic.  That’s why we have tabled it on the agenda of this Privacy Focus Group meeting.
